A) RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The Consumer has the right to withdraw from the contract concluded with the Seller via the Store, subject to the provisions described in point B) ( EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT) , within 14 days without giving any reason.

  2.  The deadline for withdrawal from the contract expires after 14 days from the date:
    In order for
    the Consumer to exercise the right to withdraw from the contract, he must inform the Seller,
    using the data provided in § 2 of the Regulations ,
    about your decision to withdraw from the contract
    by means of an unequivocal
    statement (for example a letter sent by post)
    or information sent by
    e-mail).
    1. On which the Consumer came into possession of the goods or on which a third party other than the carrier and indicated by the Consumer came into possession of the goods.

    2. On which the Consumer came into possession of the last item or on which a third party, other than the carrier and indicated by the Consumer, came into possession of the last item in the case of a contract requiring the transfer of ownership of multiple items that are delivered separately.

  3. The consumer may use the sample form available in convenient returns, but this is not mandatory. Proof of purchase (receipt or copies thereof) must be provided.

  4. In order to meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information concerning the exercise of his right to withdraw from the contract before the deadline for withdrawal expires.

    CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT

  5. In the event of withdrawal from the concluded contract, the Seller shall return to the Consumer all payments received from him, including the costs of delivery of the goods (with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Consumer's decision to exercise the right to withdraw from the contract.

  6. The Seller will refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution; in each case, the Consumer will not incur any fees in connection with this refund.

  7. The Seller may withhold reimbursement until receiving the goods or until proof of their return is provided, depending on which event occurs first.

  8. The Seller requests that the goods be returned to the following address: ul. Stoczniowców 7A, 84-230 Rumia immediately, and in any case no later than 14 days from the day on which the Consumer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Consumer sends the goods back before the expiry of the 14-day period.

  9. The consumer bears the direct costs of returning the goods.

  10. The consumer is only liable for a reduction in the value of the goods resulting from using them in a way other than necessary to establish the nature, characteristics and functioning of the goods.

  11. If the goods cannot be returned by regular mail due to their nature, the Consumer will also have to bear the direct costs of returning the goods. The Consumer will be informed about the estimated amount of these costs by the Seller in the description of the goods in the Store or when placing the order.

B) EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1.  The right to withdraw from a contract concluded at a distance does not apply to the Consumer in relation to the contract:
    The right to withdraw from a contract concluded at a distance does not apply to any entity other than the Consumer.
    1. Where the subject of the provision is a non-prefabricated item, manufactured according to the Consumer’s specifications or intended to meet their individual needs.

    2. Where the subject of the provision are things that after delivery, due to their nature, are inseparably connected with other things.

    3. Where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires.

C) COMPLAINTS

  1. In the event of a defect in the goods, the Buyer has the option of filing a complaint about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, provided that a guarantee has been granted.

  2.  By making use of the warranty, the Buyer may, under the terms and within the time limits specified in the Civil Code:

    1. Submit a price reduction declaration

    2. In the event of a significant defect - submit a declaration of withdrawal from the contract

    3. Request the exchange of the item for a defect-free one

    4. Request removal of the defect

  3. If it turns out that in order to consider the complaint it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver this goods, in the case of the Consumer at the Seller's expense, to the address ul. Stoczniowców 7A, 84-230 Rumia.

  4. If the product is covered by an additional warranty, information about it and its terms is available in the product description in the Store.

  5. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations.

  6. The complaint will be considered by the Seller within 14 days.

    OUT-OF-COURT COMPLAINT AND CLAIM SETTLEMENT PROCEDURES

  7.  IN in the event that the complaint procedure does not bring the expected result
     by the Consumer of the result, the Consumer may benefit from, among others: 
    1. Mediation conducted by the relevant Voivodship Inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.

    2. Assistance from the competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of the case before the arbitration court should be filed.     3. Free assistance from the municipal or district Consumer Ombudsman.
